ESA Updates: Wage Deductions

As per the update to the ESA, employers are prohibited from making deductions from employee wages in cases of cash shortages, lost property, or stolen property, particularly when others besides the employee had access to the cash or property in question.

Effective March 21, 2024, the ESA has been amended to explicitly include situations such as “dine and dash,” “gas and dash,” and other similar incidents. This means that any deductions from wages in these circumstances are not permitted.

Please ensure that all wage-related practices within your departments comply with this updated legislation.
