Do You Know the 3 Hour Rule?

In order to be able to cancel an employee’s shift without having to pay the minimum three (3) hours required by ESA (Employment Standards Act) you must cancel prior to the employee arriving on-site for their shift. Once on-site they are entitled to be paid the minimum 3 hours.

If the employee is at home or en route for their shift, you are able to cancel without having to pay the minimum three hours.  

However, if an employee is en route and driving a company vehicle, (whether it’s on site or to a client site), the organization is responsible for paying the minimum three hours pay.
