Earlier this week the Ontario government announced that it would be proposing news legislation that would protect restaurant and hospitality industry workers.
The new legislation, if passed, would end unpaid trial shifts and the ability for an employer to deduct employee wages in the event of an unpaid bill i.e. dine and dash, gas and dash or stolen property.
Other changes proposed include the requirement for employers to post in the workplace if they have a policy of sharing pooled tips. This would ensure clear communication and understanding to all staff how tips are calculated and distributed.
These updates are part of the Working for Workers Four Act, 2023 which recommends that these updates are made to the Employment Standards Act and is an extension of the Working for Workers Act 2021, 2022 and 2023.
