Did you know that a new Long-Term Illness Leave is being added to the Employment Standards Act (ESA)?
This change took effect June 19, 2025, and it’s important for employers to prepared and compliant.
Here’s what you need to know:
Eligibility:
Employees employed for at least 13 consecutive weeks will be entitled to unpaid leave if:
- They are unable to perform their job duties due to a serious medical condition, and
- A qualified health practitioner provides a certificate confirming the condition and expected leave period.
Leave Duration:
Eligible employees may take up to 27 weeks of unpaid leave within a 52-week period.
Employer Responsibilities:
Employers must retain (or arrange for retention of) specific records related to the employee’s leave for 3 years after the leave ends.
This new entitlement became law on June 19, 2025.
