New Rules for Job Postings Effective January 1, 2026

Effective January 1, 2026, new rules under the Employment Standards Act will apply to employers who post publicly advertise job postings and who have 25 ore more employees at the time of job posting.

The following changes are aimed at increasing fairness and transparency in the hiring process.

  • Job postings must show expected pay or a salary range (roles with total compensation of $200,000 or more are exempt)
  • Employers must disclose if artificial intelligence is used during hiring
  • Postings can no longer require Canadian experience
  • Employers must state if role is for a true vacancy
  • Employers must keep all job posting records, including information sent to interviewed applicants for 3 years after the job is no longer available to the public
  • Employers who interview applicants must confirm whether a hiring decision has been made within 45 days of the interview
